What this site does

No Earlier Than sets no cookies, uses no local storage, and runs no analytics, ads or trackers. Fonts, photos and scripts come from noearlierthan.com itself: your browser contacts no other site unless you follow a link or press play on a webcast.

Hosting

The site runs on Cloudflare (Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA). To deliver a page, or a calendar your calendar app refreshes, Cloudflare processes the technical data every request carries: your IP address, the time, the address requested and your browser’s or app’s identification. Cloudflare does this on my behalf under a data processing agreement; for the security and operation of its network it may also process some of this data as a controller of its own, as its privacy policy explains. The data is used to answer the request; I keep no logs of visits and store none of it myself. The legal basis is my legitimate interest in delivering the site securely and reliably (Art. 6 (1) (f) GDPR).

Cloudflare may process data in the USA. It takes part in the EU–US Data Privacy Framework, for which the European Commission has decided that the USA ensures an adequate level of protection (Art. 45 GDPR, Implementing Decision (EU) 2023/1795).

Webcasts

Launch pages can play webcasts from YouTube in the page: the launch provider’s or agency’s own, NASASpaceflight’s, NASASpaceflight’s cameras on the pads around a launch, and the mission’s other coverage, such as its news conferences or the docking at a space station. Until you press a play button, your browser contacts no one but noearlierthan.com. When you press play, the player loads from youtube-nocookie.com, YouTube’s privacy-enhanced mode, and from Google’s servers, run by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. YouTube then receives your IP address, this site’s address as referrer, as YouTube requires, and your browser’s technical data, and it may store information on your device. In this mode, Google says, a view is not used to personalize YouTube or advertising; its privacy policy applies. The legal basis is your consent, given by pressing play (Art. 6 (1) (a) GDPR, § 25 (1) TDDDG); it covers that playback, and you withdraw it at any time by closing the player or the page (Art. 7 (3) GDPR). Google may process data in the USA and takes part in the EU–US Data Privacy Framework (Art. 45 GDPR, Implementing Decision (EU) 2023/1795). Webcasts on X or NASA+ open on their own sites.

Calendar subscriptions

Your calendar app fetches a subscribed calendar regularly, from every few minutes to about once a day, from your device or from its provider’s servers, for example Apple iCloud or Google. The address carries your device’s time zone for the notes and nothing else about you.

Email

If you write to go@noearlierthan.com, your message and address are used to answer you and kept only as long as that takes. The mailbox is hosted by Apple (iCloud Mail). The legal basis is my legitimate interest in answering (Art. 6 (1) (f) GDPR).

No Earlier Than on X

No Earlier Than posts on X as @noearlierthan. If you visit the account, X Internet Unlimited Company (Fenian Street, Dublin 2, D02 AX07, Ireland) processes your data under its own privacy policy, whether you are signed in or not. I see there what anyone sees, and statistics about the account only in aggregate, never who visited. Where X and I are jointly responsible for such statistics (Art. 26 GDPR), you may exercise your rights with either of us; X holds the data. The legal basis for the account is my legitimate interest in reaching people who follow launches where they are (Art. 6 (1) (f) GDPR). X may process data in the USA; its privacy policy explains on what basis.

People named on the site

Crew members appear with their names, roles and portraits as NASA, SpaceX and Launch Library 2 publish them for their missions, and with links to the public profiles that Launch Library 2 or their agency lists for them, since the site reports on these flights (Art. 6 (1) (f) GDPR). A crew member may object at any time at go@noearlierthan.com.

Your rights

You have the right to access, rectification, erasure, restriction of processing, data portability and objection (Art. 15 to 21 GDPR), and to lodge a complaint with a supervisory authority, for example the State Commissioner for Data Protection and Freedom of Information Baden-Württemberg. Your right to object

Where data is processed on the basis of legitimate interests (Art. 6 (1) (f) GDPR), you may object at any time on grounds relating to your particular situation (Art. 21 GDPR). Write to go@noearlierthan.com.
